Challenges and responses to the prevention and control of microplastic pollution in Antarctica from a perspective of international law
Microplastics,as an emerging pollutant,have caused significant damage and threats to Antarctic ecosystems,human health and climate change.The Antarctic Treaty System,the United Nations Convention on the Law of the Sea and its Implementing Agreements,and other international environmental treaties provide an international legal basis for the prevention and control of microplastic pollution in Antarctica.However,the prevention and control of microplastic pollution in Antarctica continue to face the challenges of insufficient supply of specific norms,overlapping and disputes over the application of the treaties in Antarctic waters,a vacuum in the enforcement of some of the activities leading to microplastic pollution in Antarctica,and deficiencies in the liability regime for microplastic pollution in Antarctica.In order to cope with the predicament of the prevention and control of microplastic pollution in Antarctica,it is necessary to clarify the relationship between the application of existing rules of international law,focus on playing an active role of the general principles of international environmental law,improve and innovate the pollution prevention and control system in the Antarctic Treaty System,and explore and construct an effective prevention and control mechanism under the framework of the international legally binding instrument on plastic pollution,including in the marine environment.
