摘要

近年来,平台经济的快速发展,带动了外卖骑手等新业态就业群体规模的壮大.用工算法是外卖平台远程操纵骑手劳动全过程的关键,实现了平台企业、劳动者、生产者和消费者的无缝链接,也展现出"算法霸权"与劳动者权益保护之间的激烈冲突,让平台用工算法成为一个亟待解决的社会治理问题.文章从外卖平台管理"代理者"视角,分析外卖平台用工算法的特点及导致的后果,阐述外卖平台用工算法侵害劳动者权益的具体表现,借鉴海外算法治理经验,提出平台用工算法治理的多元体系框架,为促进我国平台经济行稳致远提供政策建议.

Abstract

In recent years,the rapid development of the platform economy has driven the growth of employment groups in new formats such as food delivery riders.Labor algorithms are the key to remotely controlling the entire labor process of delivery riders of online delivery platforms,which not only achieve seamless connection between platform enterprises,workers,producers,and consumers,but also demonstrate the fierce conflict between"algorithm hegemony"and the protection of workers'rights and interests,making the labor algorithm of the platform an urgent social governance problem to be solved.This paper analyzes the characteristics and consequences of labor algorithms of online delivery platforms from the perspective of"agents"in management,elaborates on the specific manifestations of labor rights infringement by labor algorithms of online delivery platforms,draws on overseas algorithm governance experience,proposes a diversified system framework for platform labor algorithm governance,and provides policy recommendations for promoting the stable and sustainable development of China's platform economy.
