法律方法视角下乳业企业数据财产权的司法困境之思辨

摘要
乳业企业数据财产权作为一种新型权利,在财产权之上具有法律的引致条款,但却并没有足够明确的法律为其提供裁判依据,在新的利益诉求下,其中权利转化过程应以"确认""定型""论证"在裁判过程中层层递进,乳业企业的司法困境在一定程度上与法律关系的运用密切相关,若不当的适用法律方法,会对案件的裁判造成诸多影响,因此,要加强众多法律方法在司法实践中的应用.
Abstract
As a new type of right,the data property right of dairy enterprises has a legal causing clause on the property right,but there is no clear enough law to provide judgment basis for it,among them,the process of rights transformation should be Confirmed,Stereotyped Argumentation in the process of judgment,and the judicial predicament of dairy enterprises is closely related to the application of legal relations to a certain extent,if the improper application of legal methods,the judgment of the case will create many impressions,therefore,we should strengthen the application of many legal methods in judicial practice.
