人工智能介入案例指导的现实基础及优化对策

在司法实践与人工智能融合的大背景下,有必要将案例指导制度的实施与人工智能技术的应用结合起来,使人工智能介入案例指导工作.人工智能的介入有其现实基础:一是有智能法律推理为其提供技术支持,二是它可满足当前案例指导工作的一些现实需求,可助弱化案例生成的行政化色彩,利于指导性案例的检索、援引与推广,促进裁判尺度统一.目前,人工智能介入案例指导实践还面临着一些困境或问题,如司法数据库存在缺陷,人工智能的角色定位困难,智能系统的案例标注技术尚不完善.因此,还有必要进一步采取相关优化对策:建设大体量、高质量的国家司法数据库,以利于人工智能深度学习、计算分析;将人工智能对案例指导下司法裁判的介入定位于"辅助",以保障裁判结果公平公正;优化案例数据提取标注的方法和效果,以便人工智能系统进行准确有效的自动识别.
The Application and Optimization of Artificial Intelligence in Guiding Cases
Under the background of the integration of judicial practice and artificial intelligence,it is necessary to combine the implementation of the case guidance system with the application of artificial intelligence technology.The intervention of artificial intelligence has its practical basis:First,intelligent legal reasoning provides the technical support for it;Second,artificial intelligence can meet some practical needs of current case guidance work,help weaken the administrative color of case generation,facilitate the retrieval,reference,and promotion of guiding cases,and promote the unification of the judgment scale.At present,the intervention of artificial intelligence in the case guidance system still faces some difficulties or problems,such as defects of the judicial database,the difficulty of positioning artificial intelligence,and the imperfect case annotation technology of artificial intelligence system.Therefore,it is necessary to adopt corresponding countermeasures:Building a large and high-quality national judicial database to facilitate deep learning and computational analysis,positioning the intervention of artificial intelligence in judicial judgment under the case guidance system as"auxiliary",optimizing the method and effect of case data extraction and annotation so that the artificial intelligence system can carry out accurate and effective automatic recognition.
