Application of Regional Exhaustion Principle of Intellectual Property Rights in the RCEP Framework
Currently,trade cooperation among countries or regions within the RCEP framework is flourishing in the context of globalization,and the trend of building a common market and trade liberalization within the RCEP region has become increasingly apparent in recent years.Therefore,based on multidimensional theoretical arguments and practical analysis of relevant typical cases at home and abroad,combined with a comparative law perspective,it is found that the regional exhaustion principle of intellectual property rights has legitimate and necessary application within the RCEP region,especially considering its long-term application in the European Union,which provides legislative reference value.After a comparative assessment,it is believed that this principle is more in line with the development trend of the RCEP region.Accordingly,it is proposed from a legislative perspective that in the future,provisions on the gradual application of unified exhaustion principle of intellectual property rights within the region can be added through,for example,the signing of ancillary treaties to the RCEP agreement,in order to promote the construction of a common market and the protection of consumer rights within this region.
