计算型反垄断:数智化时代的监管挑战与转型

迈向数智化时代,计算技术的应用提升了相关市场界定的复杂性,加剧了市场力量认定的难度,导致竞争损害分析的不确定性骤增.计算型反垄断通过大数据分析改进反垄断分析,利用计算工具与方法识别垄断行为,研发与应用监管科技,提升反垄断监管的自动化、精准化与智能化水平.计算型反垄断旨在为反垄断分析注入计算理性,提升反垄断监管过程的智能化,实现法律与技术监管的融合治理,在本质上是对反垄断监管逻辑的整体重塑.当然,计算型反垄断的重塑效应是有限的,应客观看待其适用范围、解决方法与应用效果.在具体的实现路径上,现阶段至少要从高质量的市场监管数据集合的形成、一体化智能监管平台的建设、反垄断监管体制机制的数字化改革三个方面推进.
As we enter the era of digital intelligence,computing technology has increased the complexity of defining relevant markets,intensified the difficulty of identifying market power,and significantly heightened the uncertainty surrounding competitive harm analysis.Computational antitrust aims to enhance antitrust analysis through big data analytics,identify monopolistic behaviors using computational tools and methods,and develop regulatory technologies that improve the automation,precision,and intelligence of antitrust regulation.Computational antitrust approach seeks to inject computational rationality into antitrust analysis,enhance the intelligence of the antitrust regulatory process,and achieve an integration of legal and technological regulation,essentially reshaping the logic of antitrust regulation as a whole.However,there are limits to this reshaping effect;its scope of application,solutions,and effectiveness must be viewed objectively.In terms of specific implementation pathways,it is essential at this stage to promote at least three aspects:the formation of high-quality market regulatory data collection,the construction of an integrated intelligent regulatory platform,and the digital reform of antitrust regulatory institutional mechanisms.
