At present,surgical robots in the weak artificial intelligence stage cannot escape their"product"attribute and are classified as medical devices.Therefore,the principle of liability for disputes over damage caused by surgical robots should logically start with product liability.However,the current application of product liability in disputes caused by surgical robots in China is not promising.This article analyzes the three main challenge and the legal reasons behind the application of product liability regulations for human damage caused by surgical robots in China,and proposes relevant suggestions for improvement to help resolve the regulatory dilemma associated with such disputes.
