Digital Reform of Administrative Approval:Operation Mechanism and Rule of Law Guarantees
From e-government to smart government,digital reforms have constituted a source of innovation in the administrative approval system,and digital reforms and innovations such as"one-window access",automated administrative approvals and data-driven auditing and management linkages have facilitated the reorganization of administrative approval functions and the re-engineering of processes,with the logic of inter-facial,discretionary,automated and agile governance embedded behind them.However,the scientific and rule of law level of the current administrative approval policy experiment is still insufficient,and the digital reform of administrative approval is facing the challenge of flattened structure to the legalization of authority,the impact of automated review expansion on fair discretion,the violation of civil rights by the expansion of digital power,and other negative externalities.In the face of the inherent tension between the rising form of digital approval and the traditional administrative legal system,the digital rule of law government has become a key institutional arrangement in response to the change in administrative methods and tools,which calls for the establishment of a mechanism to safeguard the organization of the digitalization of administrative approvals,the clarification of the boundaries and roles of automated administrative approvals and the reinforcement of rule of law safeguards for the rights of citizens in the activities of public data processing.
