Research on the Sinking Path of Administrative Enforcement Power Facing the Improvement of Law Enforcement Efficiency——An Empirical Study of Five Pilot Towns and Streets in Zhejiang province
In the context of the in-depth promotion of comprehensive administrative law enforcement reform,the sinking of administrative law enforcement power(townships,streets)is the focus of reform at this stage.From the internal investigation of law,the essence of the sinking of enforcement power lies in the redistribution of power.Therefore,theoretically,the sinking of power effectively breaks the dilemma of the fragmentation of administrative subject,ensures the finality of the distribution of power,enhances the standard degree of administrative supervision,and helps to optimize the allocation and operation of administrative power.The pilots in Zhejiang Province also proved the effectiveness of this model from the perspective of practice.However,in practice,there are still problems,such as the defects of the sinking mechanism,the difficulty of matching the resources of the authority,and the self-restraint of the block relationship.It is necessary to improve the organizational law structurally,adhere to the"whole government"theory,build a differentiated power sinking system,improve the allocation and management mechanism of law enforcement personnel,and give consideration to both substantive justice and procedural justice of law enforcement.The effectiveness of law enforcement will be enhanced by integrating the fragmented layers of governance through data information platforms.
