摘要
《行政处罚法》授予乡镇人民政府、街道办事处行政处罚权,标志着综合执法改革进入新阶段.回顾近三十年的综合执法改革实践,可以发现,此项改革虽然促进了行政执法权合理配置,提高了行政效能,便利了行政相对人,但也存在着改革的碎片化和单一化问题.综合执法改革应坚持整体政府理念,在设计和实施综合执法改革时,应将政府作为一个整体,坚持系统思维,整体设计,统筹配置不同执法部门的执法权限,实现执法事项的有机综合和科学配置;统筹确定综合执法部门与行政主管部门的相互关系,合理划定其权力边界;统筹安排综合执法改革与其他改革的配套措施,协同推进相关改革.
Abstract
The Law of the People's Republic of China on Administrative Penalty grants the power of administrative penalty to township people's governments and sub-district offices,marking a new stage of comprehensive law enforcement reform.Reviewing the practice of comprehensive law enforcement reform in the past nearly 30 years,it can be found that while this reform has promoted the rational allocation of administrative law enforcement power,improved administrative efficiency and facilitated administrative counterparts,it has also been characterized by fragmentation and homogenization.The comprehensive law enforcement reform should adhere to the idea of the whole government.When designing and implementing the comprehensive law enforcement reform,we should regard the government as a whole,adhere to systematic thinking and overall design,and coordinate the allocation of law enforcement authority of different law enforcement departments,so as to realize the organic synthesis and scientific allocation of law enforcement matters.We should make overall plans to determine the relationship between comprehensive law enforcement departments and administrative departments in charge,and reasonably delineate their power boundaries.We should also make overall arrangements for supporting measures for comprehensive law enforcement reform and other reforms,and promote relevant reforms in a coordinated manner.
