The development of AI poses challenges to the traditional legal framework.It's a rule principle rooted in the changes in the elements of legal relationships triggered by AI applications.On the one hand,the intellectualization of legal relationship subjects and acts complicates the exercise of rights(powers),the fulfillment of obligations,and the assumption of responsibilities.On the other hand,the factual intellectualization of rights objects leads to innovations in the rules governing the objects of rights and even conflicts of rights.To implement the rights and obligations of AI-related subjects and clarify their responsibilities,it is necessary to improve the legal system of AI.This provides a theoretical basis for China to construct an AI rule system.Additionally,the governance of new technologies in the U.S.has always been decentralized,but its recent local legislation exhibits a trend of"horizontal"unification and specialization,reflecting the characteristics of AI legal relationship.This serves as a wake-up call for China to strengthen our competitive edge as a major power in the field of AI governance.China should adopt a decentralized approach to AI legislation first,follow up with specialized AI legislation,and simultaneously focus on addressing shortcomings in law enforcement.
