发展新质生产力背景下我国植物新品种保护制度完善路径研究

摘要
新质生产力的提出,对于推动种业高质量发展具有重要指导意义.植物新品种保护制度作为种业振兴的重要知识产权制度,是种业高质量发展的重要保障.植物新品种的特有属性以及与其他类型知识产权的差异化功能是构建植物新品种知识产权组合研究框架的重要依据.而从新质生产力三要素——劳动力、劳动资料、劳动对象的新要求可创设出植物新品种知识产权组合促进新质生产力的研究模型.基于以上框架和模型的分析,我国植物新品种保护制度在推动新质生产力发展过程中存在不足,相关立法应体现我国植物新品种保护制度的完善路径.
Abstract
The concept of new quality productive forces is of great significance for promoting the high-quality development of the seed industry.The new plant variety protection system,as an important intellectual property system for the revitalization of the seed industry,is a key guarantee for its high-quality development.This paper first constructs a research framework for the intellectual property portfolio of new plant varieties based on their unique attributes and the differentiated functions from other types of intellectual property.Secondly,according to the new requirements of the three elements of new quality productive forces—labor force,labor means,and labor objects,a research model is established for the intellectual property portfolio of new plant varieties to promote new quality productive forces.Furthermore,considering the shortcomings of China's new plant variety protection system in promoting the development of new quality productive forces,this paper proposes ways to improve China's new plant variety protection system.
