五四宪法"建立社会主义社会条款"的内在张力及其融贯

摘要
"建立社会主义社会条款"是"五四宪法"中社会主义原则的规范基础,构成了新中国通过法治轨道向社会主义社会过渡的总方针.该条款的入宪既与党的过渡时期总路线的提出息息相关,也受到了近代社会主义思潮与我国儒家文化传统的深刻影响.不过,囿于社会主义的共同富裕本质与人民民主法制的个体自由底色之间的紧张关系,"建立社会主义社会条款"自入宪伊始便存在着内在张力,并引出社会主义能否与法治相兼容的宪法难题.对此,新中国的制宪先贤们从我国的历史与国情出发,提出了以基本国策为内核的制宪方案,创造性地将建设社会主义社会作为政治责任委托给立法机关.该方案在赋予社会主义以规范性的同时,又维护法治的自由传统,为我国当前共同富裕的法治保障提供了历史借鉴.
Abstract
The"Provision of the Establishment of Socialist Society"is the normative basis for the socialist principle in the 1954 Constitution,which constitutes the general policy for the transition of the new China to the socialist society through the rule of law.The inclusion of this provision in the Constitution is related to the formulation of the CPC's general line for the transitional period,as well as being deeply influenced by modern socialist thinking and Confucian cultural tradition.However,due to the tension between the socialist nature of common wealth and the individual freedom of the people's democratic legal system,the provision has been subject to inherent tension from the very beginning of its inclusion in the Constitution,and have led to the constitutional dilemma of whether or not socialism can be compatible with the rule of law.In response,the constitution-makers of New China put forward a constitutional program based on the basic national policies from the perspective of China's history and national conditions,creatively entrusting the legislature with the political responsibility of building a socialist society.This program,while giving a normative character to socialism and at the same time upholding the liberal tradition of the principle of the rule of law,provides a historical reference for the current rule of law guarantee of common wealth in China.
