摘要
2023年世界银行正式发布了营商环境新评估体系,新增"市场竞争"一级指标,引起全球各国关注.在国际经贸规则"实质公平化"发展和规则重构中提升我国话语权的双重背景下,聚焦"市场竞争"评估体系,重点探索新增指标所体现的立法导向,深入挖掘新指标的制度价值,对我国对标新指标优化营商环境意义重大、影响深远.市场竞争指标中国化作为高水平制度型开放的重要契机和中国式现代化制度建设的重要一环,应当及时妥当地实现本土化.在分析我国市场竞争制度体系建设的实践,以及对标对表新指标的"先行先试"的基础上,可找出我国在市场竞争领域可能的失分点,从而为优化我国市场竞争营商环境有针对性地提出对策:包括在战略层面强化竞争政策基础地位,在制度层面完善市场竞争体制机制,在操作层面丰富监管工具提升竞争监管质量和效率.
Abstract
In 2023,the World Bank officially released a new assessment system for the business environment,adding the primary indicator of"market competition",which attracted global attention.Against the backdrop of the dual enhancement of China's discourse power in the development and restructuring of international economic and trade rules towards"substantive fairness",focusing on the assessment system of"market competition"and exploring the legislative orientation reflected by the new indicators have significant and far-reaching implications for China's optimization of the business environment by benchmarking against the new indicators.The localization of market competition indicators is an important opportunity for high-level institutionalized openness and an important part of China's modernization of institutional construction.It is imperative to localize these indicators in a timely and appropriate manner.By analyzing China's practices in building the market competition institutional system and"pioneering and trying out"the new indicators,identifying possible shortcomings in China's market competition field,proposing targeted strategies to optimize China's market competition business environment,including strengthening the foundation of competition policy at the strategic level,improving the market competition system mechanisms at the institutional level,and enriching regulatory tools and enhancing the quality and efficiency of competition supervision at the operational level.
