统一法律适用标准的体系化构造——以同案同判为视角

摘要
统一法律适用是维护国家法治统一和保障公民受到平等对待在司法审判中的基本要求,同案同判是推动统一法律适用标准的司法支点.为了化解法律适用分歧,可以在同案同判的理论视域中,建立统一法律适用的标准体系.在内容标准上,以基本权利要素为"同案"识别的比较要点,有助于实现部门法律适用标准的普遍化.在程序标准上,引入平等参与程序和司法说理程序,能够促进统一法律适用标准的可接受性.在技术标准上,综合运用类比推理和演绎推理两种论证规则,保证法律解释的连贯性与法律适用的正确性.
Abstract
To keep the unified application of law is the basic requirement to maintain the unity of national rule of law and ensure that citizens are treated equally in judicial trials,and the like cases be treated alike is the judicial fulcrum to promote the unified application of law standards.In order to resolve the differences in the application of law,we can establish a unified standard system of law application in the theoretical perspective of treating like casesalike.In terms of content standard,taking the basic rights'elements as the comparison point of'like cases'identification is helpful to realize the universality of the department law application standard.In terms of procedural standards,the introduction of equal participation procedures and judicial reasoning procedures can promote the acceptability of uniform standards for the application of law.In the technical standard,the two argumentation rules of analogical reasoning and deductive reasoning are integrated to ensure the consistency of legal interpretation and the correctness of legal application.
