历史是一个国家和民族的集体记忆,也是一个国家政权合法性的重要来源和基础.作为国家的根本法,宪法是政权合法性的根本规范依据.从历史发展来看,坚持依宪执政是中国共产党总结建党以来正反两方面经验教训得出的重要结论.认识和把握依宪执政的历史逻辑,需要坚持马克思主义唯物史观的立场和方法,将其放在社会革命的大历史进程中来定位,既不能超越历史,也不能滞后于时代.坚持依宪执政是中国共产党自我革命精神的具体体现,也是中国共产党领导人民推进社会革命历史逻辑的必然要求.中国共产党在今天的社会主义中国如何依宪执政,马克思主义经典作家没有提供现成答案,照搬照抄其他国家宪法模式也都行不通,必须从中国实际出发,不断探索依宪治国、依宪执政的中国道路.
Abstract
History is the collective memory of a country and a nation,and it is also an important source and foundation of the legitimacy of a country's political power.As the fundamental law of a country,the Constitution is the fundamental normative basis for the legitimacy of political power.From the perspective of historical development,adhering to governance complied with the Constitution is an important conclusion drawn by the CPC from summing up the positive and negative experiences and lessons since its founding.To understand and grasp the historical logic of governance complied with the Constitution,it is necessary to adhere to the position and method of Marxist historical materialism,and position it within the overall historical process of social revolution.It can neither tanscend history or lag behind the times.Adhering to governance complied with the Constitution is aconcrete embodiment of the spirit of self-revolution of the CPC and it is also an inevitable requirement of the historical logic of the CPC leading the people to promote social revolution.How canthe CPC govern in accordance with the Constitution in today's socialist China?The classical Marxist writers have not provided a ready-made answer,and copying the constitutional models of other countries will not work.We must start from China's reality and constantly explore the Chinese path of exercising of state power complied with the Constitution and governing complied with the Constitution.
