中国特色刑法解释学话语体系的建构

摘要
建构中国特色刑法解释学话语体系,就是用人民群众所熟悉的语言、概念、理论、思维方式解释中国刑法,讲好中国刑法故事,既能让老百姓从相关刑法解释中了解自己的行为性质、预测自己的行为后果,也为司法工作人员妥当地处理现实案件提供指引.建构具有中国特色的刑法解释学话语体系,必须进一步坚定四个自信,处理好自主性与世界性的有机统一,以我国现行的刑法规定为基本依据,挖掘我国刑法的传统特色,以理论界和实务界已广泛接受并约定俗成的话语体系为基础,适当借鉴域外刑法学中的有益概念,并将其融入到我国现有的刑法话语体系之中.
Abstract
The construction of a discourse system of criminal law hermeneutic with Chinese characteristics is to explain the Chinese criminal law with the language,concepts,theories,and ways of thinking that are familiar to the people,and to tell the story of Chinese criminal law well.This can not only enable the people to understand the nature of their behavior and predict the consequences of their behavior from the relevant hermeneutics of criminal law,but also provide guidance for judicial personnel in dealing with real-life cases in a proper manner.To construct a discourse system of criminal law hermeneutic with Chinese characteristics,we must further strengthen our confidence in the system and cultural,handle the organic unity of autonomy and cosmopolitanism,take the current criminal law provisions as the basic basis,explore the traditional characteristics of Chinese criminal law,and take the discourse systemthat has been widely accepted and agreed upon by the theoretical and practical circles as the basis,appropriately draw on some useful concepts in foreign criminal law and integrated them into the existing criminal law discourse system of our country.
