摘要
党的十八大以来,以习近平同志为核心的党中央高度重视家风建设,创造性地推动家风入法入规.家风入法入规具有丰富的法治样本价值:实现了中华优秀传统文化与党的优良传统的制度化、法治化;呈现了党规国法关系,是党规党纪严于国法、规随身变、党内法规同国家法律相协调的具体体现;展现了法治中国建设的诸多特色,包括依法治国和以德治国相结合、依规治党和以德治党相统一、依法治国和依规治党有机统一.家风入法入规生动体现了习近平法治思想的原创性贡献,是考察法治中国建设的一个经典样本,也是考察中国共产党解决大党独有难题的一个切入点.
Abstract
Since the 18th National Congress of the Communist Party of China,the Party Central Committee with Comrade Xi Jinping as the core has attached great importance to the construction of family virtues,creatively promoting the incorporation of family virtues into national laws and Party regulations.The inclusion of family virtues in laws and regulations has rich value as a rule of law sample:it has achieved the institutionalization and legalization of the excellent traditional Chinese culture and the fine traditions of the party.It has presented the relationship between the Party regulations and national laws,and is a concrete manifestation of the Party rules and discipline being stricter than the state laws,the rules changing with the circumstances,and the coordination between the inner party regulations and state laws.It has demonstrated many distinctive features of the construction of a rule-of-law in China,including the integration of rule of law with the rule of virtue,the unity of governing the Party by regulations and with virtue,and the combination of law-based governance of the country and rule-based governance of the Party.The incorporation of family virtues into laws and regulations vividly embodies the original contributions of Xi Jinping thought on rule of law.It serves as a classic sample for studying the construction of a rule-of-law in China and a vivid"slice"for examining how the CPC tackle the special challenges that a large party faces.
