A Study on the Legal Protection Mechanism of Tea Geographical Indication in China——Take the Tea Geographical Indication in Hunan Province as an Example
At present,China mainly relies on the trademark law,the protection regulations of geographical indication products and the management measures of agricultural product geographical indication to protect tea geographical indication,and is supplemented by relevant laws and regulations such as the Anti-Unfair Competition Law,Criminal Law,and other administrative rules for coordinated protection.Through the analysis of the current situation of the protection of Hunan tea geographical indication,it is found that China still faces a series of dilemmas in the legal protection of tea geographical indication,including the lack of coordination in legislation,the unreasonable delineation of the regional protection scope of geographical indications and the repeated protection.Therefore,it is necessary to further strengthen the legal protection of tea geographical indication in improving the legislative system of geographical indications,ra-tionally delineating the regional protection scope of tea geographical indications and strengthening relevant measures.
