目的：探讨安慰剂使用的伦理困境与法理争议。方法：对使用安慰剂正反两方面的观点进行简要梳理，运用康德哲学思想进一步剖析安慰剂的伦理缺陷与公正缺失。结果与结论：在临床试验中使用安慰剂，违背了康德“人本身就是目的”的哲学思想，给受试者带来不合理的风险，亦违背了医学原则。为了降低安慰剂的不合理风险，应对临床试验进行更为科学的设计，保护每一位受试者的生命健康权。
Abstract
Objective:To focus on the ethical dilemma of placebo and its legal dispute.Methods: Both of the positive and negative views on the use of placebo were brielfy sorted out with the application of Kant's philosophy for further analysis. Results and Conclusion:The use of placebo in clinical trials violated Kant’s philosophicla principle “People end in itself” and the principles of medicine, and was subject to an unreasonable risk. In order to reduce the unreasonable risks in clinical trials and protect life and health of every subject, the clinical trials should be designed more scientiifcally.
