产权视角下古民居更新路径研究——以黄山市唐模村为例

在城市化进程不断推进中,古民居的保护更新正在走向差异化的变革.本研究以黄山唐模村为例,从产权视角出发,梳理唐模村产权变更历程和建筑产权现状,分析产权法律法规缺失、产权交易繁杂、产权破碎化、资金不足、管理权责混乱等负面影响,并从产权、资金、参与者三方面揭示其现实存在的困境.在此基础上,引入小规模、渐进式更新理念,尝试在制度完备基础上,建立不同产权主体不同更新策略-循序分期更新项目-更新实施效果评估反馈的更新体系,为同类型古民居更新提供路径上的参考.
Research on the Path of Ancient Residential Renewal from the Perspective of Property Rights:a Case Study of Tangmo Village,Mount Huangshan City
In the process of urbanization,protection and renovation of ancient dwellings are moving towards dif-ferentiated transformation.This study takes Tangmo Vil-lage in Mount Huangshan as an example,from the per-spective of property rights,combs the process of property rights change and the current situation of building property rights,analyzes the negative effects of the lack of prop-erty rights laws and regulations,the complexity of property rights transactions,property rights fragmentation,insuffi-cient funds,and the confusion of management rights and responsibilities,and reveals its real dilemma from the three aspects of property rights,funds,and participants.On this basis,the concept of small-scale and gradual renewal is introduced,and an attempt is made to establish an update system with different renewal strategies for different prop-erty rights subjects-sequential and phased renewal proj-ects-evaluation and feedback of the implementation effect of the renewal,providing a path reference for the renewal of the same type of ancient residential buildings.
