论农村幼儿教师的法律地位与权利保障路径

摘要
农村幼儿教师是保障农村教育事业稳定发展的重要主体.农村幼儿教师的身份认定存在法律真空,导致福利待遇权难以落实、"身份制"明显、专业权利行使受限和救济渠道模糊等问题.目前亟须根据不同类型幼儿园性质,分别确定农村幼儿教师的教育公务员、特殊劳动者和普通劳动者的法律地位.应设定指导性权利条款,划分主体管理责任,确立幼儿教师专业权利法定原则,拓宽权利救济渠道,以实现农村幼儿教师权利的多重保障.
Abstract
Rural preschool teachers are an important subject to ensure the stable development of rural education.The status of rural preschool teachers is vacuum,which leads to problems such as the difficulty in implementing their right to welfare treat-ment,the obvious"identity system",the limited exercise of professional rights,and the vague right relief channels.Therefore,now it is urgent to determine the legal status of rural preschool teachers'educational civil servants,special workers and ordinary workers respectively according to the nature of public parks,non-profit private parks and for-profit private parks.We should set up guiding rights clauses,divide management responsibilities,establish legal principles for preschool teachers'professional rights,and broaden the channels for rights relief to achieve multiple guarantees for rural preschool teachers'rights.
