实施认罪认罚从宽制度广泛而深远的社会效果,使得该制度与国家治理现代化产生实质勾连.国家治理现代化对认罪认罚案件量刑建议的科学性提出更高要求.通过量刑建议规范化达致量刑建议精准化,是刑事司法领域推进国家治理现代化的必然路径.检察官在认罪认罚案件中提出确定刑量刑建议有利有弊,这决定量刑建议精准化具有实施限度,即对绝大部分刑事案件可提出确定刑量刑建议,对少数特殊刑事案件宜提出幅度刑量刑建议.认罪认罚案件量刑建议精准化包括程序和实体两个维度,程序维度的主要内容是全面收集量刑事实和充分听取量刑意见,实体维度的主要内容是构建量刑建议形成的一般方法和具体方法.在"三步式"量刑方法的基础上增加适用认罪认罚情节环节,形成"四步式"量刑建议的一般方法.结合某种犯罪的法益特征,以其量刑标准为根据确定基准刑,构建此类犯罪量刑建议形成的具体方法.
The implementation of the leniency system for confession and punishment has far-reaching social effects,which have resulted in a substantial connection between this system and the modernization of state governance.In this context,there are higher demands for the scientificity of sentencing recommendations for cases of Pleading Guilty and Accepting Punishments.Standardising sentencing suggestions is an inevitable step towards modernising national governance in the field of criminal justice.While there are advantages and disadvantages to prosecutors proposing sentencing recommendations in cases of confession and punishment,it is important to ensure that the recommendations are objective and based on the facts of the case.Therefore,it has been determined that there are limits to the implementation of precise sentencing suggestions.For the vast majority of criminal cases,sentencing suggestions can be made,while for a few exceptional criminal cases,sentencing recommendations should be made with a range of sentencing.The precision of sentencing suggestions in cases of Pleading Guilty and Accepting Punishments includes two dimensions:procedural and substantive.The procedural dimension involves collecting sentencing facts and listening to sentencing opinions.The substantive dimension involves constructing general and specific methods for forming sentencing recommendations.A general method of"four-step"sentencing suggestions is formed by adding the application of confession and punishment circumstances to the"three-step"sentencing method.A method for formulating sentencing recommendations for specific crimes has been established based on their legal interests and sentencing standards.
