摘要
习近平总书记在中共中央政治局第十次集体学习时的讲话中阐述并强调加强涉外法制建设,为我国完善涉外法制、加强涉外法治提出了要求并指明了方向.习近平新时代中国特色社会主义思想特别是习近平法治思想和习近平外交思想是加强涉外法制建设的指导思想.作为我国首部基础性、综合性的调整对外关系的宪法相关法,2023 年7 月1 日开始实施的《对外关系法》是促进我国对外关系工作法制化的标志和里程碑,为加强涉外法制建设奠定了重要基础.落实习近平总书记首次提出的建设同高质量发展、高水平开放要求相适应的涉外法治体系和能力的要求,加强涉外法制建设,需要坚持党的领导;与改革开放同步,以涉外法制巩固并引领创新;国内法和国际法有机衔接,积极推动全球治理;加强专业人才培养和队伍建设;不断总结经验,丰富和提升法治大国的文明魅力.
Abstract
General Secretary Xi Jinping elaborated and emphasized the strengthening of the foreign-related legal system in his speech at the tenth collective study session of the Political Bureau of the CPC Central Committee,setting forth requirements and direction for China to improve its foreign-related legal framework and enhance the foreign-related legal system.Xi Jinping Thought on Socialism with Chinese Characteristics for a New Era,especially the concepts on the rule of law and diplomacy,is the guiding principle for enhancing the construction of foreign-related legal systems.The"Foreign Relations Law",which came into effect on July 1,2023,as China's first foundational and comprehensive law regulating foreign relations in line with the constitution,serves as a symbol and milestone for promoting the legalization of China's foreign-related affairs and lays an important groundwork for strengthening the construction of a foreign-related legal system.To implement General Secretary Xi Jinping's first requirements of building a foreign-related legal system and capacity compatible with high-quality development and high-level opening up,and strengthen the construction of foreign-related legal system,the following points should be focus on:adhere to the leadership of the Party;keep pace with reform and opening up,consolidate and lead innovation with foreign-related legal system;organically connect domestic law with international law,actively promote global governance;strengthen the cultivation of professional talents and team building;constantly sum up experience,enrich and enhance the civilized charm of a great country ruled by law.
