摘要
游戏外挂黑产犯罪现象愈演愈烈,迫切需要积极有效治理.然而,目前学界缺乏对此问题的系统性解释框架.鉴于此,引入200 份游戏外挂黑产犯罪经典案例,采用扎根理论质性研究方法,旨在深入剖析游戏外挂黑产犯罪的机制、危害,并探寻治理对策.研究发现,游戏外挂黑产犯罪的形成涉及犯罪机遇刺激和犯罪特性刺激的相互作用,导致从业人员形成犯罪心理.在这种心理的支配下,形成了一个明晰的"上游制作游戏外挂—中游售卖游戏外挂—下游使用游戏外挂"黑产犯罪链条.因此,治理游戏外挂黑产犯罪的关键在于综合运用技术与法律手段.游戏运营方应通过采用数据加密和机器学习等先进技术手段,提升网络游戏外挂制作的门槛,强化游戏保护层;立法部门应全面完善游戏外挂黑产犯罪行为的法律框架,明确定位游戏外挂问题为行业主要防范方向,制定清晰的外挂定义和认定标准,构建合理的责任分配秩序;司法机关在审理相关案件时应合理认定外挂行为,区分不同类型的游戏外挂,以更准确地依法处理;执法部门在打击游戏外挂犯罪方面需引进更多专业技术人才,定期审查相关网站和平台,构建全方位的防控体系.
Abstract
The phenomenon of game cheats crime is becoming more and more serious,and there is an urgent need for active and effective governance.However,the the current academic community lacks a systematic explanatory framework for this problem.In view of this,200 classic cases of black market crimes involving game cheating software were introduced,and the qualitative research method of Grounded Theory is adopted to deeply analyze the formation mechanism and governance countermeasures for such criminal activities.It is found that the formation of game cheats black market crime involves the interaction of criminal opportunity stimulus and criminal characteristic stimulus,leading to the formation of criminal psychology among practitioners.Under the domination of this mentality,a clear black market crime chain of"upstream production of game cheats-midstream sale of game cheats-downstream use of game cheats"has been formed.Therefore,the key to governing game cheats blackmail lies in the comprehensive use of technical and legal means.Game operators should enhance the threshold of online game cheats market and strengthen the game protection layer by adopting advanced technical means,such as data encryption and machine learning;the legislative department should comprehensively improve the legal framework of the game cheats crime,including clearly positioning the game cheats problem as the main preventive direction of the industry,formulating clear cheat definitions and identification standards,and building a reasonable order of responsibility allocation;the judicial authorities should reasonably identify the cheats behavior and distinguish different types of game cheats when adjudicating the relevant cases to deal with them more accurately according to the law;law enforcement departments need to introduce more professional and technical talents in the fight against the crime of game cheats,regularly review related websites and platforms,and build an all-around preventive and control system.
