摘要
公民参与审查起诉为防范检察权滥用提供了新的思路,迎合了提升检察公信力的现实期待,是打破审查起诉封闭性、拓展外部监督渠道的应有之义.然而,现阶段我国的公民参与审查起诉在组织体系、效力规则以及责任机制等方面尚不完备,制度发展陷入困境.域外公民集中参与的组织模式、决定型参与的效力模式以及合作型的检察责任模式为我国公民参与审查起诉的体系化建构提供了有益经验.我国宜建立协调公民参与审查起诉的独立机构,增设复议制度,赋予公众意见一定的程序拘束力,完善检察官责任豁免机制,以提升公民参与的积极性和有效性.
Abstract
Citizens'participation in the review and prosecution provides a new way to prevent the abuse of procuratorial power,meets the realistic expectation of improving the credibility of the procuratorial system,and is a necessary step to break the closed nature of the review and prosecution and expand external supervision channels.However,at this stage,the participation of citizens in the review and prosecution in my country is still incomplete in terms of organizational system,effectiveness rules,and responsibility mechanism,and the system development is in a dilemma.The organizational model of concentrated participation of citizens in foreign countries,the effectiveness model of decisive participation,and the cooperative procuratorial responsibility model provide useful experience for the systematic construction of citizens'participation in the review and prosecution in my country.my country should establish an independent institution to coordinate citizens'participation in the review and prosecution,add a reconsideration system,give public opinions a certain procedural binding force,and improve the prosecutor's liability exemption mechanism to enhance the enthusiasm and effectiveness of citizens'participation.
