Pathways to Improve the Procedures of the Mandatory Exit Mechanism for Representative Inheritors of Intangible Cultural Heritage
The procedure of the mandatory exit mechanism for representative inheritors of intangible cultural heritage(ICH)are crucial for regulating mandatory exit actions,preventing the abuse of administrative power,pro-tecting the legal rights and interests of administrative counterparts and other stakeholders,and achieving the legisla-tive goals of the management system for ICH representative inheritors.In comparison to the"Interim Measures for Determination and Administration of Representative Inheritors of National-level Intangible Cultural Heritage Pro-jects"issued by the former Ministry of Culture in 2008,the"Measures for Determination and Administration of Representative Inheritors of National-level Intangible Cultural Heritage Projects"revised and issued by the Ministry of Culture and Tourism in 2020 have built a more scientifically rational procedure for the identification of ICH repre-sentative inheritors,based on improved identification conditions,providing operational guidelines for the identifica-tion actions.However,the new regulations have certain deficiencies in the procedural provisions for the mandatory exit mechanism of ICH representative inheritors.Legislative deficiencies not only affect the efficient and rational ex-ecution of mandatory exits but also deviate from the fundamental demands of procedural legal principles.Based on practical review,further improvements should be made to the procedures of the mandatory exit mechanism for ICH representative inheritors,guided by the principles of administrative procedural law,to ensure the legality and pro-cedural fairness of the mandatory exit mechanism.
