由城乡分治到城乡融合:"两委"组织法修订的若干问题

《中华人民共和国城市居民委员会组织法》和《中华人民共和国村民委员会组织法》的修订提到议事日程,受到立法部门和学界关注,一些问题值得重视并可形成共识.在修订的方向上,"两委"组织法应顺应国家治理体系和治理能力现代化及基层治理体系和治理能力现代化的大趋势,促进基层治理由城乡分治逐步走向城乡融合,促进村庄治理由政经一体逐步走向政经分离.在修订的原则上,"两委"组织法最好是能改则改、应改尽改.关于法的名称,居委会组织法不应名为《中华人民共和国城市社区居民委员会组织法》,而应当名为《中华人民共和国居民委员会组织法》,而与《中华人民共和国村民委员会组织法》对应起来.关于章的标题,"两委"组织法应突出组织法的特征,在语言文字形式上协调统一.关于条的表达,"两委"组织法,对于同样的事项、同样的规范,完全可以也应当用同样的表达.
From Urban-Rural Segregation to Urban-Rural Integration:Key Issues in the Revision of Organic Laws of the"Two Committees"
The proposed revision of the"Organic Law of the Urban Residents'Committees of the People's Republic of China"and the"Organic Law of the Villagers'Committees of the People's Republic of China"has gathered attention from both legislative departments and academic circles.Such revision presents an opportunity to address several critical issues.In terms of the revision's direction,the organic laws of the"Two Committees"should align with the broader trends of modernization of the national governance system and capacity,as well as the modernization of grassroots governance systems and capacity.This includes promoting a shift from urban-rural seg-regation to urban-rural integration in grassroots governance and encouraging the separation of politics and economy in village governance.In terms of revision principles,the organic laws of the"Two Committees"should be revised wherever necessary and appropriate.Specifically,the law should:(1)adopt a consistent name.The organic law of the residents'committees should be named"Organic Law of the Residents'Committees of the People's Republic of China"instead of"Organic Law of the Urban Residents'Committees of the People's Republic of China",alig-ning it with the"Organic Law of the Villagers'Committees of the People's Republic of China".(2)Standardize chapter titles.The organic laws of the"Two Committees"should clearly reflect their nature as organic laws,ensu-ring consistency and unity in language and textual format across chapters.(3)Ensure consistent expression in arti-cles.The organic laws of the"Two Committees"should utilize uniform expression for identical matters and regula-tions throughout the text.
