Legal Benefit Attribute of Personal Information and the Path to Criminal Law Protection
The rapid advancement of modern science and technology, represented by information technology, not only generates significant benefits but also introduces new risks and hidden dangers. The indiscriminate disclo-sure and illegal use of personal information have resulted in violations or threats to other legal interests of citizens, making the protection of personal information a critical issue in the development of the rule of law and the mainte-nance of data order in contemporary society.Currently, the legal benefit attributes of the crime of violating citizens'personal information under our criminal law are not very clear, making it difficult to reflect the value of criminal norms. In the context of an intelligent society, the legal benefits associated with personal information are no longer confined to a singular attribute within traditional business frameworks;instead, they have evolved into a comprehen-sive form that encompasses individual, social, and national legal interests. The path for enhancing the criminal law's protection of personal information in our country should focus on balancing and coordinating the rational use of in-formation by government and enterprises with the necessity of safeguarding personal information. This can be a-chieved by categorizing personal information based on sensitivity levels, facilitating dynamic management and timely protection.Furthermore,it is essential to strengthen the consistency, progressiveness, and developmental aspects of provisions related to citizens'personal information protection across existing legal norms, industry regulations, and criminal law, promoting unity, coordination, and standardization within the legal framework.
