Historical Changes and Future Evolution of the Scope of Administrative Prosecutorial Supervision
The scope of administrative prosecutorial supervision in China exhibits distinct characteristics of both temporality and stage-specificity.In the early years following the establishment of the People's Republic of China,a general supervision mechanism was implemented.Although this approach faced numerous challenges and could hardly be deemed successful overall,it highlighted the nature of the newly-born people's government and had significant positive implications for the construction of a law-based government and an administrative supervision system in the new era.Since 1989,administrative prosecutorial supervision was initially confined to the realm of administrative liti-gation supervision for a long time;nevertheless,it marked a new starting point for the restriction and supervision of administrative power since the reform and opening-up.Since the 18th National Congress of the Communist Party of China,administrative prosecutorial supervision has gradually transcended the limitations of administrative litigation supervision t in practice,forming a new pattern of prosecutorial supervision.Within this new context,determining the scope of prosecutorial supervision necessitates a review and reflection on the historical development of administrative prosecution,a response to various misinterpretations,and,more importantly,careful consideration of its practical feasibility.It is essential to fully acknowledge existing difficulties and issues,striving to overcome and resolve them to achieve an organic unity of supervision scope and quality of supervision t.
