浅谈离婚冷静期制度设置

摘要
我国《民法典婚姻家庭编》增加了离婚冷静期制度,立法者创设离婚冷静期制度的目的是缓解人们仓促离婚的现象.但目前离婚冷静期制度在实施过程中仍存在诸多困境,比如有些人对于《民法典婚姻家庭编》是否应规定诉讼离婚冷静期制度上存在分歧,离婚冷静期制度是否需要建立相应的配套制度还存有争议.为此,通过分析离婚冷静期制度的价值为视角,论证《民法典》设立离婚冷静期制度的合理性,并通过借鉴国外离婚冷静期制度经验,主张在制度实施过程中应区分适用,推进离婚冷静期限内权利义务关系的适时变动,建立辅助的配套制度,以确保我国离婚冷静期制度在实践中能够更好地实施.
Abstract
Civil code of our country"marriage and family make up"increased divorce a cooling-off period system,lawmakers create a cooling-off period system is the purpose of the divorce in order to alleviate the hasty divorce phenomenon.However,there are still many difficulties in the implementation of the di-vorce cooling-off period system.For example,some people disagree on whether the cooling-off period system should be stipulated in the Marriage and Family Edition of the Civil Code,and whether the corresponding supporting system should be established in the divorce cooling-off period system is controversial.Therefore,by analyzing the value of divorce cooling-off period system as a perspective,this paper demonstrates the rationality of the establishment of divorce cooling-off period system in the Civil Code,and by drawing lessons from foreign experience of divorce cooling-off period system,advocates that the system should be differentiated and applied in the implementation process,promotes the timely change of rights and obliga-tions in divorce cooling-off period,and establishes auxiliary supporting system.In order to ensure that our divorce cooling-off period system can be better implemented in practice.
