Foucault's critique of"droit"is not a simple negation of"droit",but also leads to a novel conception of"droit"as a relativised form of power.Adopting a genealogical perspective,Foucault argues that,in an era of discipline and normalisation,"droit"has the functions of critique and resistance that must be preserved.However,these functions of"droit"also entail that we cannot understand"droit"in the conventional sense,which is based on the truth of the general subject and the soverignty.Foucault's"droit"must instead be understood as the special right based on truths of special subjects.
