Analysis on the Cultivation of Civil Law Thinking of"Real Rights and Debt Dichotomy"in the Classroom Teaching of Property Law
The traditional legislative model of single line civil law in China and the legislative characteristic of"no distinction between property and debt"can easily lead to fragmented civil law thinking among students.After the promulgation of the Civil Code of the Pe-ople's Republic of China,the rule of"real rights and debt dichotomy"was implemented throughout the entire civil law system.The sys-tematic requirements of the Civil Code and the rule of the"real rights and debt dichotomy"need to update the traditional classroom tea-ching content and methods of property law.The classroom teaching of"real rights and debt dichotomy"is conducive to helping students build a systematic knowledge of civil law and cultivate good civil law thinking.The classroom teaching of"real rights and debt dichot-omy"needs to be carried out from concepts,specific rules,application scenarios,case studies,etc.This is a research and teaching method that goes from abstract to concrete,from general to special,and from theory to application.
