环境质量标准能否作为排污者主张合规抗辩的依据

摘要
关于环境质量标准能否作为排污者主张合规抗辩的依据,要立足于我国现实的立法基础、司法实践、不同类型污染的内在特征和规律.在拟制型污染侵权中,环境质量标准不能作为排污者主张合规性抗辩的依据.在实质型污染侵权中,排污者可以排污行为符合环境质量标准而从因果关系方面否认侵权责任的构成,环境质量标准作为排污者不承担侵权责任的理由主要体现在实质型污染侵权中.
Abstract
Whether environmental quality standards can serve as a basis for polluters to argue for compliance should be based on current legislative foundation,judicial practice,and the inherent characteristics and laws of different types of pollution in China.In simulated pollution infringement,environmental quality standards cannot serve as a basis for polluters to assert compliance defenses.In substan-tive pollution infringement,polluters can deny the composition of infringement liability from a causal perspective while their pollution behavior meets environmental quality standards.Environmental quality standards,as a reason for polluters not to bear infringement lia-bility,are mainly reflected in substantive pollution infringement.
