On the appropriate aggravation of penalties for the crime of purchasing trafficked women and children
China has maintained a stringent stance against human trafficking.However,the risk of women and children being abducted remains severe,and the exposure of a series of pernicious cases has prompted reflection.In judicial practice,the penalties for the crime of purchasing trafficked women and children are often lenient,with legal provisions inadequately enforced.Therefore,legislative bodies should raise the statutory maximum penalty for this crime to five years' imprisonment according to the increased social harm caused by such acts,and make much stricter judicial determination in conjunction with legislative measures.Attention should be paid to preventing"secondary disasters"such as confusion in the application of penalties and a decrease in the motivation of law enforcement,which may result from the increase in penalties,and to supplementing the system with institutional mechanisms such as an early warning system for abnormal population movements and a"one-stop"assistance platform,so as to truly activate the system of penalties for human trafficking crimes,and to ensure a powerful safeguard for the rights of women and children.
