On the National Obligation to Realize the Digital Benefit Rights of the Elderly
As a new right enjoyed by the elderly in the digital age,the right to digital benefit has the value of respecting and pro-tecting human rights,responding to the people's needs and actively aging,and filling the gaps in existing legal protection.The realiza-tion of the digital benefit rights of the elderly relies on national obligations,which are the fundamental guarantee for the realization of the digital benefit rights of the elderly.In terms of content system,the national obligation to realize the digital benefits of the elderly in-cludes three levels:respect,protection and payment.The obligation to respect requires that the state shall not hinder the exercise of the digital freedom rights of the elderly.The obligation of protection requires that when the digital benefit rights of the elderly are infringed upon by a third party,the state should promptly stop and eliminate the obstruction.The obligation to pay requires the state to create conditions in material,service,and institutional aspects for the realization of the digital enjoyment rights of the elderly.The violation of the obligation of the state to ensure the realization of the digital benefit rights of the elderly is actionable,the violation of the obligation to respect is highly actionable,the violation of the obligation to protect is partially actionable,and the violation of the obligation to pay is minimally actionable.
