行政机关负责人出庭应诉制度再省思

摘要
行政机关负责人出庭应诉制度,是我国贯彻落实全面依法治国的重要探索,为我国行政争议实质性预防化解贡献了制度力量.但由于该制度的正常运行需要行政机关负责人具有较好的法律专业素质、付出更多额外的时间和精力等原因,在当前情况下,这一制度并没有在实践中得到很好实施,出庭应诉的实际效果并不理想.为充分发挥该制度在依法治国和法治政府建设中的积极作用,需要进一步明确出庭应诉的行政机关负责人范围和案件种类,衔接法治政府考核评定和责任追究,鼓励相关部门参与监督该制度的实施与完善.
Abstract
The system of administrative officials appearing in court to respond to lawsuits is an important exploration of China's im-plementation of comprehensive rule of law,and has contributed institutional strength to the substantive prevention and resolution of ad-ministrative disputes in China.However,due to the fact that the normal operation of this system requires administrative officials to have good legal professional qualities and invest more extra time and energy,this system has not been well implemented in practice under the current situation,and the actual effect of appearing in court to respond to lawsuits is not expected.To fully leverage the positive role of this system in the rule of law and the construction of a rule of law government,it is necessary to further clarify the scope and types of administrative officials who appear in court to respond,connect the assessment and accountability of the rule of law government,and encourage relevant departments to participate in supervising the implementation and improvement of this system.
